 آفریدی قبائل کا درہ خیبر اور سکندر اعظم کی پسپائی

 آفریدی قبائل کا درہ خیبر  وہ علاقہ ہے ا، جہاں سے گزرنے والے آفریدی قبائل کو حراج اور بڑے بڑے فاتحین  کو بھی سر جکھانا پڑتا تھا

تقریباً تمام مؤرخین نے آفریدی قبائل کو وہ بلائیں لکھا ہے جو جنگ سے محبت کرتے ہیں اور یہی محبت ان کے دشمن کی بدترین شکستوں کا باعث بنتی رہی۔

درّہ خیبر، جہاں سے افغانستان جانے اور وہاں سے یہاں آنے والوں کو راستے کے حصول کے لیے یہاں پر آباد آفریدی قبائل کو خراج دینا پڑا اور دنیا کو فتح کرنے والے بڑے بڑے فاتحین کو بھی یہاں سر جھکانا پڑا۔

غیر ملکی اور مقامی لکھاری اس بات پر متفق ہیں کہ جتنے زیادہ حملے درّہ خیبر پر ہوئے اتنے شاید ہی دنیا کے کسی شاہراہ یا گزر گاہ پر ہوئے ہوں گے۔

دنیا کا یہ مشہور درّہ خیبر پشاور سے 11 میل کے فاصلے پر یہاں بنے تاریخی دروازے باب خیبر سے شروع ہوتا ہے اور یہاں سے اندازاً 24 میل یعنی طورخم کے مقام پر پاک افغان سرحد پر ختم ہوتا ہے جہاں سے لوگ ڈیورنڈ لائن عبور کر کے افغانستان میں داخل ہوتے ہیں۔

باب خیبر اور طورخم کے بیچ کا یہ علاقہ یہاں کسی بھی بری نیت سے آنے والے کے لیے خطروں سے اتنا بھرپور ہے جس کی مثال کہیں اور نہیں ملتی، یہی وجہ ہے کہ دنیا اور اس خطے میں فاتح کہلانے والا کوئی حکمران اس درّے اور اس کے مکینوں کو قابو نہیں کر سکا۔

اس راستے کے دونوں طرف تقریباً ڈیڑھ ہزار فٹ اونچی پہاڑی چٹانیں اور ان کے بیچ ناقابل دریافت غار واقع ہیں۔ یہ درّہ یہاں کے لوگوں کے لیے جنگی لحاظ سے ایک ایسا قدرتی حصار ہے جسے دنیا کے کسی جنگی ہتھیار سے فتح نہیں کیا جا سکتا۔

اس کا سب سے خطرناک حصہ تاریخی علی مسجد کا مقام ہے جہاں پر یہ درّہ اتنا تنگ ہوجاتا ہے کہ اس کی چوڑائی صرف چند میٹر رہ جاتی ہے اور یہی وہ جگہ ہے جہاں کی پہاڑی چوٹیوں پر چھپے چند قبائل بھی سینکڑوں فٹ نیچے راستے سے گزرنے والے ہزاروں فوجیوں کے لیے قیامت بپا کرتے تھے اور اُنھیں زچ کرکے پسپا ہونے پر مجبور کر دیتے تھے۔ یہاں تک کہ اُنھیں لاشیں اٹھانے کے لیے بھی ان قبائل کی بات ماننی پڑتی تھی۔

پشاور شہر سے چند کلومیٹر کے فاصلے پر واقع تحصیل جمرود میں بنے اس دروازے کو اگر دشمن کے لیے موت کی وادی کا دروازہ کہا جائے تو غلط نہیں ہوگا۔

اس دروازے سے ہی پورے درّہ خیبر کی اہمیت اجاگر ہو جاتی ہے۔ سابق صدر پاکستان فیلڈ مارشل ایوب خان کے دور حکومت میں یہ دروازہ بنایا گیا۔ جون 1963 میں مکمل ہونے والے اس دروازے کی تعمیر اس وقت کے کیمبل پور اور آج کے اٹک کے دو مستریوں گاما مستری اور اُن کے بھتیجے صادق مستری نے کی۔

یہ تعمیر تقریباً دو سال میں مکمل ہوئی۔ اس دروازے پر مختلف تختیوں پر ان حکمرانوں اورحملہ آوروں کے نام نصب ہیں جنھوں نے اس راستے کو استعمال کیا۔

اس دروازے کے قریب بحری جہاز نما قلعہ سکھ جرنیل ہری سنگھ نلوہ نے تعمیر کروایا تھا تاکہ درہ خیبر پر نظر رکھنے کے لیے فوجی یہاں رکھے جا سکیں۔

اس علاقے کی زیادہ تر آبادی آفریدی قبیلے کی ذیلی شاخ کوکی خیل سے تعلق رکھتی ہے۔

پروفیسرڈاکٹر اسلم تاثیرآفریدی خیبر سے متصل ضلع اورکزئی میں گورنمنٹ ڈگری کالج غلجو کے پرنسپل ہیں اور یہاں کی تاریخ پر اتھارٹی کی حیثیت رکھتے ہیں۔

وہ کہتے ہیں کہ ایران کو فتح کرنے کے بعد پختونوں کے صوبے گندھارا کا قصد کرنے والے سکندرِ اعظم کی فوجوں کو اسی درّہ خیبر پر سب سے زیادہ مزاحمت کا سامنا کرنا پڑا اور پھر اُنھیں اپنی ماں کی ہدایت پر راستہ بدلنا پڑا تھا۔

وہ کہتے ہیں کہ آفریدی قبائل کی اس سخت مزاحمت کی وجوہات جاننے کے لیے سکندرِ اعظم کی ماں نے اُنھیں ہدایت کی کہ اس علاقے کے چند مکینوں کو دعوت پر اس کے پاس بھیجا جائے۔

آفریدی قبائل کے یہ سردار سکندرِ اعظم کی ماں کے ساتھ بات چیت میں مصروف تھے جہاں پر اُنھوں نے ان سے سوال کیا کہ آپ میں سے سردار کون ہے۔

اس پر ہر کسی نے اس بات کا دعویٰ کیا کہ وہی سردار ہے اور یہ سب آپس میں الجھ پڑے۔ یہیں پر سکندرِ اعظم کی ماں کو احساس ہو گیا کہ یہ لوگ جب اپنوں میں سے کسی کو خود سے بڑا ماننے کو تیار نہیں تو وہ سکندرِ اعظم کو کیا مانیں گے۔

ماں نے بیٹے کو نصیحت کی کہ وہ ہندوستان جانے کے لیے درّہ خیبر کے راستے کا خیال دل سے نکال لے، یوں سکندرِ اعظم کو اپنا راستہ بدلنا پڑا اور وہ باجوڑ کے راستے اپنی منزل کی طرف چلے۔

سکندرِ اعظم کے آج کے پاکستان کے علاقوں میں داخلے کے حوالے سے سابق انگریز گورنر سر اولف کیرو نے اپنی کتاب ’پٹھان‘ میں لکھا ہے کہ سکندر پشاور میں داخل نہیں ہوسکا اور اس نے جو دریا عبور کیے وہ کوس یوسپلا اورگوریس تھے جن کے درمیان ایک پہاڑی چشمہ واقع تھا جو صرف کونٹر یعنی پنج کوڑہ کا بالائی حصہ ہوسکتا ہے جہاں سے آج کل ڈیورنڈ لائن گزرتی ہے اور اس نے آج کے باجوڑ کے ایری گایوں کے مقام نواگئی کا راستہ اختیار کیا۔ 

معروف صحافی اللہ بخش یوسفی اپنی مشہور کتاب تاریخ آفریدی میں لکھتے ہیں کہ درّہ خیبر کے علاقے میں بڑی تعداد میں بدھ مت سے متعلق بہت زیادہ آثارِ قدیمہ نمودار ہوئے تاہم اپنے اعتقادات کی بدولت پختون ان مورتیوں کے خلاف تھے اور اُنھیں توڑ دیا کرتے تھے۔

اسی علاقے میں لنڈی خانہ کے قریب ایک پہاڑ پر عہد قدیم کی ایک قلعہ نما عمارت ہے جسے یہاں کےآفریدی ’کافر کوٹ‘ کے نام سے جانتے ہیں۔

اللہ بخش یوسفی لکھتے ہیں کہ سطان محمود غزنوی نے ہندوستان پر حملوں میں پختونوں سے دشمنی مول لینے کے بجائے ان پر اعتماد کیا اور اُنھیں اپنا فخر کہہ کر متعارف کرواتے۔

جن سرداروں نے محمود غزنوی کے ساتھ جنگوں میں حصہ لیا ان میں ملک خانو، ملک عامو، ملک داور، ملک یحییٰ، ملک محمود، ملک عارف، ملک غازی، ملک شاہد اور ملک احمد وغیرہ شامل ہیں۔ محمود غزنوی نے سومنات کو فتح کیا تو پختون بے جگری سے لڑے اور اس طرز لڑائی نے اُنھیں پختونوں کو خان کا نام دینے پر مجبور کیا اور کہا کہ صرف پختون ہی خان کہلانے کے لائق ہیں۔

مؤرخین لکھتے ہیں کہ ہندوستان فتح کرنے کی خواہش میں جب ظہیرالدین بابر اپنی طاقت کے بھروسے پر خیبر کی طرف چلے تو آفریدی اُن کے راستے میں لوہے کی دیوار بن گئے اور بابر کو یہ سمجھ آ گئی کہ طاقت کے بل پر وہ درّہ خیبر کو عبور نہیں کر سکتے اور اگر ایسا ہووبھی گیا تو اُنھیں افغانستان کی جانب پیش قدمی کرتے ہوئے ہمیشہ اپنے عقب کے غیر محفوظ ہونے کی فکر لاحق رہے گی۔

لہٰذا اپنے آپ کو مضبوط کرنے کے بعد اُنھوں نے ایک بار پھر 1519 میں دوبارہ خیبر کو فتح کرنے کی ٹھانی۔ ظہیرالدین بابر کو سخت لڑائی کے بعد صرف ایک رات علی مسجد میں گذارنے کا موقع مل سکا۔ وہ جمرود تو پہنچ گئے لیکن اُنھیں خیال آیا کہ اگر وہ پنجاب جاتے ہیں تو ایسا نہ ہو کہ واپسی پر یہ قبائل اُن کی راہ کاٹ لیں۔

سکھ حکمران رنجیت سنگھ کو یقین تھا کہ پختونوں پر اقتدار قائم رکھنے کے لیے کسی مضبوط ہاتھ کی ضرورت تھی، اس لیے سکھوں کے مشہورترین انتظامی جرنیل ہری سنگھ نلوہ کو بھاری لشکر کے ساتھ پشاور کا انتظامی افسر مقرر کیا گیا۔

ہری سنگھ نے پختونوں کو تو پریشان کیا تاہم وہ قبائلیوں کا کچھ نہ بگاڑ سکے اور ان قبائل کے اقدامات کی بدولت خود رنجیت سنگھ پر ان کی دہشت طاری ہوگئی۔

اسی دہشت کا اثر تھا کہ ان قبائلیوں کے حملوں سے بچنے کے لیے ہری سنگھ نلوہ نے باب خیبر کے مقام یعنی درہ خیبر کے دہانے پر قلعہ تعمیر کرنے کا فیصلہ کیا اور 1836 میں اس پر کام کا آغاز ہوا۔

یوں تو سکھوں نے یہ قلعہ قبائل کے حملوں سے بچنے کے لیے بنایا تھا تاہم افغانستان کے امیر دوست محمد خان نے اسے اپنے خلاف عزائم کا نشان سمجھا اور سکھ فوجوں پر حملہ آور ہوگئے جہاں پر ہری سنگھ نلوہ مارے گئے۔

انگریز سکھ لشکر کے افغانستان میں قیام کے وقت یہ ضروری تھا کہ ان کے پیچھے واپسی کا راستہ یعنی درہ خیبر کھلا رہے لیکن یہ آفریدی قبائل کو مواجب یعنی معاوضہ دیے بغیر ممکن نہ تھا۔

انگریزوں کو بھی پتہ تھا کہ آفریدیوں کو مواجب نہ ملا تو وہ خود بھی سکون سے نہ رہ سکیں گے، چنانچہ اُنھیں درّہ خیبر میں سکون رکھنے کے لیے آفریدیوں کو سالانہ ایک لاکھ 25 ہزار روپے مواجب دینا پڑا۔

افغانستان میں دو سال تک قیام کے بعد جب انگریزوں کو شکست ہوئی تو وہ اپنی حلیف فوج یعنی سکھوں کو لے کر واپس روانہ ہوئے تاہم درّہ خیبر کے اندر آفریدی قبائل نے اُن کے ساتھ ایسا سلوک کیا کہ اُن کے چودہ طبق روشن ہوگئے۔

درّہ خیبر کے اندر علی مسجد کے مقام پر انگریزوں کی توپیں اور بندوقیں سب کچھ آفریدی قبائل نے چھین لیا۔

ان آفریدی قبائل کے ساتھ معاہدوں کی رو سے ان قبائل کو تحفظِ راہ اور قیام امن وغیرہ کے لیے یہ رقوم دی جاتی ہیں جسے مقامی زبان میں مواجب کہتے ہیں۔

یہ رقوم سال میں دو بار ادا کی جاتی ہیں اور اسے وصول کرنے والا فخر محسوس کرتا ہے۔ ایسے قبائلی ملک اور عمائدین بھی ہیں جو ان قبائلی علاقوں سے دور رہتے ہیں اور اکثر اوقات اُنھیں اپنے حصے کے مواجب کے چند روپوں کو لینے کے لیے ہزاروں روپے خرچہ کرنا پڑتا ہے تاہم وہ اس خراج سے دستبردار نہیں ہوتے۔

حکومتیں ان قبائلی عمائدین کو احترام کے طور پر لنگی (دستار) کے نام سے بھی رقم ادا کرتی ہے۔

آفریدی کب سے یہاں ہیں؟

پروفیسر ڈاکٹر اسلم تاثیر آفریدی کہتے ہیں کہ ان آفریدیوں کی اس علاقے جمرود سے لے کر تیراہ اور چورہ تک موجودگی اور ان کے لیے جلال آباد سے پاکستان کے موجودہ شہر مردان تک ایک پختون ریاست بھی قائم کی گئی تھی جس کے بنانے والے بایزید انصاری یا پیر روخان تھے اور اس میں وزیرستان کے علاقے بھی شامل تھے۔

وہ کہتے ہیں کہ ہندوستان کی زراعت اور سرسبز و شادابی ہی کی وجہ سے اسے سونے کی چڑیا سمجھا جاتا تھا اور اس لیے فاتحین نے ہمیشہ اس پر قبضہ کرکے اسے زیرِ نگیں کرنا چاہا اور ان فاتحین نے گندھارا یعنی پختونوں کے صوبے کا راستہ اختیار کیا جہاں پر درّہ خیبر ان کے راستے کی سب سے بڑی دیوار بنا۔

وہ کہتے ہیں کہ باب خیبر کے ارد گرد کے علاقے میں قریبا 29 لڑائیاں خود ارد گرد کے مختلف قبائل کے مابین لڑی گئیں جس میں سکھوں، انگریز اور خود قبائل کے بیچ یہ جنگیں ہوئیں۔

آفریدی قبائل کی یوں تو اور بھی کئی شاخیں ہیں لیکن ہر شاخ الگ الگ علاقے میں آباد ہے۔ ان کی سب سے بڑی شاخ کوکی خیل باب خیبر سے لے کر درّہ خیبر اور پھر تیراہ کے بڑے علاقے میں آباد ہے۔

اس قبیلے کے ملک عطااللہ جان کوکی خیل کے بھتیجے اکرام اللہ کوکی خیل کا کہنا ہے کہ جمرود کا کنٹرول لینے کے لیے ان کے قبیلے کی مدد تہکال کے ارباب سرفراز خان نے کی تھی۔ ان کا کہنا ہے کہ جہاں دنیا کے ہر حصے سے آنے والے جنگجوؤں نے اس علاقے کو فتح کرنا چاہا، وہیں پر اس علاقے میں اپنے قبائل کے مابین بھی اقتدار اور زمین کے لیے رسّہ کشی جاری رہی جس میں دشمنوں کے علاوہ اپنوں نے بھی کردار ادا کیا۔

تاہم وہ کہتے ہیں کہ اب کافی عرصے سے علاقے میں امن ہے اور تمام قبائل اپنی اپنی حدود میں پُرامن زندگی گزار رہے ہیں۔

Hujra and Jirga

Hujra: The Hujra which represents the sociable character of the Pukhtoons is a useful institution and it plays a pivotal role in their daily life. It serves as a club, "dormitory, guest house and a place for ritual and feastings". It is a centre for social activities as well as a Council Hall for the settlement of family and inter-tribal disputes. It is used as a male dormitory where bachelors of the village sleep. It is a guest house where guests are jointly entertained by village folk and a community centre for betrothals, marriages and social functions. Even condolences are offered in the Hujra on the demise of a person and here sympathy is expressed with the bereaved family. It is a place of public resort where village elders and youngsters get-together in their leisure hours to discuss tribal, national and international affairs and matters of mutual interest. "The guests and strangers are fed and sheltered free of all charges in the village Hujras".

The Hujra and Jirga are inter related. It is not only a meeting place of the villagers but it is also used as a platform for the Jirga's meetings where important decisions are made and family quarrels and tribal disputes are amicably resolved. In some places the Hujra happens to be the property of one man but in tribal areas it is a common property. Hujra, hubble bubble (Cheelam) and Rabab (String instrument) and an earthen pitcher are inseparable and are considered its part and parcel. Though the hubble bubble still retains its old place yet the music of Rabab with the accompaniment of the pitcher is vanishing and their place is being taken up by radio, transistor and television sets.
The Hujras are generally well fortified. They have one or two towers with a loopholed parapet for the purpose of defence of the village and firing down and along the wall in case of an outbreak of hostilities. The youngsters of the village in general and bachelors in particular sleep in the Hujra to guard the village in case of blood feuds. The Hujra usually consists of two or three rooms with adjacent veranda and a courtyard. A number of bedsteads or charpaees, pillows and quilts and praying rugs available in Hujra for the guests.

Jirga: "A mass meeting of the elders of the whole of the Afridi tribe, for instance, would correspond very much to the old `Shiremote' of the Saxon heptarchy; and, indeed, there is more in the simile than one would expect at first glance, for the democratic spirit that is so characteristic a feature in the gradual growth of English customs finds its counterpart in the spirit of liberty and right of free action that is one of the most cherished prerogatives of the Pathan tribesmen, be he ever so humble".
Democracy is not alien to the genius of the Pukhtoons, as they are carrying on their typical and rudimentary form of government on democratic principles since times immemorial. A unique feature of tribal life is the Jirga system, a council or assembly of tribal elders which closely resembles the Athenian democracy of the City States of ancient Greece. This participatory sort of democracy was practiced by the Pukhtoons long before Locke, Rouseau and other eminent philosophers expounded their theories about democracy.
Pukhtoonwali is the code of ethics of the Pukhtoons, the Jirga their Parliament or National Assembly and intrepidity and frankness an essential trait of their character. An atmosphere of equality pervades in tribal area and even a poor man dressed in rags considers himself equal to his adversary or his rich compatriot. This spirit is well reflected in their Jirga system, which, like the ancient Greek democratic institutions signifies their love for democracy.
The Jirga of today also plays an important and constructive role in solving the tribal matters. It is an authority for settling disputes and dispensing even-handed justice to all and sundry irrespective of their social status, influence and wealth. All matters including the question of peace and war within tribal limits, fall within the purview of the Jirga. It consists of the leading Maliks and tribal elders. There are no hard and fast rules for the selection of Jirga members. All tribal elders Speen Geeri or (grey-beards) are considered eligible for its membership and each one of them has a right to speak and freely express his opinion. However, Jirgas generally consist of persons known for their honesty and integrity. The Jirga exercises both executive and judicial roles and settles all disputes pertaining to the distribution of land, property, blood feuds, blood money and other important inter-tribal affairs on the basis of tribal conventions, traditions and principles of justice. It performs judicial functions while settling a dispute and discharges police functions when a threat to peace and tranquility or danger to the life and property exists within tribal limits.
The Jirga usually deals with inter-tribal affairs and serves as an instrument for dispensing speedy and cheap justice. After careful consideration, the Jirga decides the disputes on the basis of available evidence.
The Jirga assembles in a Hujra or a village mosque or in an open field outside the village under a shady tree. The Jirga members usually sit in a circle without any presiding officer. This Round Table Conference like a meeting without a chairman clearly reflects their love of democracy and principle of equality irrespective of birth, wealth etc.
The Jirga conducts its proceedings in a simple manner. It interviews both the parties, gives them a patient hearing and examines witnesses to ascertain the facts of the case. After searching enquiries, the Jirgamakes every possible endeavour to find an impartial and acceptable solution of the problem. The Jirga's decision is generally based on Shariat, local traditions, justice and fair-play. In serious cases the Jirgaasks a party to clear itself of the imputed charge by an oath on the Holy Quran. This seals the issue once for all, as the religion is an extremely strong a force. It announces its decision only when the majority of its members reach an agreement. But Jirga members deem it prudent to obtain the consent of both the parties before making its verdict public. This practice is known as WAAK or IKHTIAR (Power of attorney). It is through the instrument of Waak or Ikhtiar that the Jirga commits both the parties to abide by its decision. The Waak also gives a binding force or some sort of legal cover to the Jirga's verdict and it becomes incumbent upon the parties concerned to honour its verdict.
The Jirga reprimands the party which refuses to accept its award. In popular parlance this refusal to abide by the verdict of Jirga is called MAKH ARAWAL (lit, turning of face) or expression of disapproval over the party's behaviour. In such a case the Jirga also resorts to punitive measures for enforcement of its decision which includes fine in money and burning of the houses of the recalcitrant members. It is because of such stringent action that no one dares violate a Jirga's decision after customary approval in the form of Waak or Ikhtiar. The Jirga does not interfere in small and petty family disputes until a formal request is made by a party to intercede on its behalf. Moreover in cases of grave concern and serious nature, the Jirga assembles on its own and persuades the parties concerned to submit to its award.
The Jirga meeting usually lasts for a day or two, but in some complicated cases, its deliberations are prolonged to three or four days. It remains, however, the utmost endeavour of the Jirga to settle the dispute amicably as early as possible.
It is also one of the functions of the Jirga to ensure law and order and lasting and durable peace in the area. Here the Jirga can be likened to the General Assembly of the United Nations. As all peace loving nations can become members of the General Assembly, similarly the Jirga is composed of such elders who have stainless characters and spotless records. As no decision is taken in the United Nations without a majority vote, likewise the majority opinion prevails in the Jirga. But here the similarity ends. The Jirga is more powerful as compared to the General Assembly. It can easily enforce its decisions through a tribal lashkar and the erring party or the dissident group is promptly punished.

The Federally Administered Tribal Areas (FATA) is a semi-autonomous tribal region in northwestern Pakistan, consisting of seven tribal agencies (districts) Khyber Agency, Mohmand Agency, Kurram agency, Bajaur Agency, Orakzai Agency, North Waziristan agency and South Waziristan Agency. and six frontier regions (FRs) FR Kohat, FR Peshawar, FR Bannu, FR Lakki, FR Tank and FR D.I.Khan. FATA directly governed by Pakistan's federal government through a special set of laws called the Frontier Crimes Regulations (FCR).
History:
The region was won from the Sikh Empire (which had annexed it during Ranjit Singh's rule) in the 19th century during the British colonial period. Although the British never succeeded in completely calming unrest in the region. it served as a buffer from unrest in Afghanistan. The British Raj attempted to control the population of the annexed tribal regions with the Frontier Crimes Regulations (FCR), which gave considerable power to govern to local nobles so long as these nobles were willing to meet the needs of the British. Due to the nobles placing unchecked discretionary power into the hands of the Jirga, resulting in extensive human rights violations, the FCR has come to be known as the "black law."

Geographical location:
FATA borders Pakistan's provinces of Khyber Pakhtunkhwa (KPK) and Balochistan to the east and south, and Afghanistan's provinces of KunarNangarharPaktiaKhost and Paktika to the west and north. The territory is almost exclusively inhabited by the Pashtun, who also live in the neighbouring provinces of Khyber Pakhtunkhwa and Northern Balochistan; they are largely Muslims. The main towns of the territory are Parachinar, Miramshah, Razmak, Wanna, Jamrud, and Landi Kotal.

On March 2, 2017 the federal government approved the recommendations of the FATA reforms committee, which included the merger of the tribal areas with Khyber-Pakhtunkhwa and repeal of the Frontier Crimes Regulation (FCR) The process is expected to take five years to complete, concluding by 2022.

Administration and Constitutional Status:
The Constitution of Pakistan governs the FATA through the same rules which were framed by the British in 1901 as Frontier Crimes Regulations (FCR). The Jurisdiction of the Supreme Court and High Court of Pakistan does not extend to FATA and Provincially Administered Tribal Areas (PATA), according to Article 247 and Article 248, of existing 1973 Constitution of Pakistan. The Khyber-Pakhtunkhwa Provincial Assembly has no power in FATA, and can exercise its powers in PATA only for that which is part of Khyber-Pakhtunkhwa. FATA is ruled by a political agent who is a Godfather of the whole agency and can do whatever he wants due to a draconian law known as FCR. Each Agencies of the Federally Administered Tribal Areas is administered by a Political Agent (PA), assisted by a number of Assistant Political Agents (APA), Tehsildars(administrative head of a tehsil) and Naib Tehsildars (deputy tehsildar).

Judicial System:
All civil and criminal cases in FATA are decided under the Frontier Crimes Regulation 1901 by a Jirga (council of elders). Residents of tribal areas may, however, approach the courts (Supreme Court of Pakistan and Peshawar High Court) with a constitutional writ challenging a decision issued under the 1901 Regulation

Area and Population:
Total area of FATA is estimated around 27,220 km2  and The total population of FATA was estimated in 2000 to be about 3,341,080 people, or roughly 2% of Pakistan's population. Only 3.1% of the population resides in established townships. It is thus the most rural administrative unit in Pakistan. According to 2011 estimates FATA gained 62.1% population over its 1998 figures, totaling up to 4,452,913. This is the fourth-highest increase in population of any province.
